Terms of Service

1. Agreement to terms

These Terms of Service (“Terms”) are a binding agreement between you and Shayne (“we”, “us”), the publisher of the RummyKub app (“the app”, “the service”). By downloading, accessing, or using RummyKub, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use RummyKub. If you are under the age of majority where you live, you may use the app only with the involvement of a parent or guardian who agrees to these Terms.

3. The service

RummyKub is a digital rummy-style tile game offering solo play against AI, an optional AI voice opponent, online multiplayer rooms, and platform leaderboards and achievements. We may add, change, or remove features at any time. Some features require an internet connection or a subscription.

4. Your account

You can play some modes without an account. Online play and subscriptions require signing in with Apple or as a guest. You are responsible for activity that happens under your account and for keeping access to your device and sign-in secure. Notify us promptly of any unauthorized use.

5. RummyKub Club subscriptions

• What it includes. RummyKub Club is an auto-renewing monthly subscription (US$4.99/month, or the local-currency equivalent shown at purchase) that includes a monthly allowance of AI voice-opponent minutes (currently 60 minutes) plus zero-setup access to the voice feature.
• Billing. Payment is charged to your Apple Account or Google Play account at confirmation of purchase. The subscription renews automatically each month unless cancelled at least 24 hours before the end of the current period.
• Managing & cancelling. You manage or cancel your subscription in your App Store or Google Play account settings. Cancelling stops future renewals; you keep access until the end of the paid period.
• Voice minutes. Included voice minutes reset each billing period and do not roll over or carry forward. Unused minutes have no cash value.
• Refunds. Purchases are handled by Apple or Google and are subject to their refund policies. Except where required by law, subscription fees are non-refundable.
• Price changes. We may change subscription pricing or contents on a prospective basis; where required, we'll give notice and the chance to cancel before changes take effect.

6. Bring your own OpenAI key

Instead of a subscription, you may power the voice opponent with your own OpenAI API key. If you do, you are solely responsible for your use of the OpenAI API, for any fees OpenAI charges you, and for complying with OpenAI's terms. Your key is stored only on your device, and usage under your key is billed to you by OpenAI, not by us.

7. Acceptable use

When using RummyKub — especially in multiplayer rooms and voice chat — you agree not to:

• Harass, threaten, or abuse other players, or use hateful, obscene, or otherwise objectionable language;
• Cheat, exploit bugs, use unauthorized automation, or interfere with fair play;
• Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the service or its providers;
• Use the app for any unlawful purpose or in violation of these Terms or applicable law;
• Infringe anyone's intellectual-property or privacy rights.

We may suspend or terminate access for conduct that violates these rules.

8. User content

You may provide content such as a display name and, in Voice AI mode, spoken input. You are responsible for what you submit and confirm you have the right to submit it. You grant us a limited license to use such content only as needed to operate the service (for example, showing your display name to players in your room, or streaming audio to the voice provider to generate a response). Do not choose display names that are offensive or infringe others' rights.

9. Intellectual property & trademarks

The RummyKub app, including its code, design, graphics, and content (other than your own user content and third-party marks), is owned by us and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial enjoyment. You may not copy, modify, distribute, sell, or create derivative works from the app except as allowed by law.

10. Third-party services

RummyKub relies on third-party services including OpenAI (voice), Supabase (backend), Apple, Google, and Expo. Your use of features that depend on them may also be subject to their terms and policies. We are not responsible for third-party services and do not control them.

11. Disclaimers

The app is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that AI-generated voice responses will be accurate, appropriate, or suitable for any purpose. You use the app at your own risk.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the app. To the extent liability cannot be excluded, our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the app, your violation of these Terms, or your infringement of any third party's rights.

14. Termination

You may stop using the app at any time and may request account deletion. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

15. Governing law

These Terms are governed by the laws of Queensland, Australia, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where applicable law grants you the right to bring proceedings elsewhere.

16. Changes

We may update these Terms from time to time. When we do, we'll revise the “Last updated” date and, for material changes, provide notice. Continuing to use the app after changes take effect means you accept the revised Terms.
